2. Exclusions (Non-Refundable Services)
The following services are excluded from this Refund Policy:

Influencer Partnerships (Partial Exclusion):

Refundable: If the Company fails to secure the agreed-upon influencer(s) as explicitly detailed in the service agreement, a full or pro-rata refund for the influencer marketing portion of the fees will be issued.

Non-Refundable: Once an influencer has fulfilled their contractual obligations (e.g., content creation, posting, advertising), the corresponding payment to the Company for the influencer's services is non-refundable. This is due to our obligation to compensate the influencer for their completed work. However, if the Client cancels the influencer partnership prior to the influencer commencing work, a full refund for the influencer portion will be granted.

Campaign Management/Execution:

Refundable: In cases where the Company demonstrably fails to achieve the level of results specified in the service agreement despite reasonable efforts within the Company's control, a refund of our fees may be considered.

Non-Refundable: Costs incurred for third-party services utilized within the campaign (e.g., advertising spend on platforms like Google Ads, social media platforms) are non-refundable. This is because these costs are directly paid to the respective platforms and beyond the Company's control.

Services Performed to Client Specifications Where Client Has Approved Deliverables:

If the Company has performed services according to the Client's specific instructions and the Client has formally approved deliverables (e.g., content drafts, ad copy), no refund will be issued for those specific deliverables in the future.

Other Marketing Services:

Refundable: For other marketing services provided by the Company, refunds may be considered if the agreed-upon targets are not met, provided the failure to meet these targets is within the Company's control.

Exclusions: This refund policy does not apply to Influencer Partnerships as the success of these campaigns can be influenced by factors beyond the Company's direct control.

Other marketing services as expressly specified in a mutually executed service agreement.
3. Refund Period and Request Procedure

Refund Period:
The Client must submit a formal refund request within fourteen (7) calendar days of the "Completion Date" of the relevant service. The "Completion Date" is defined as the date on which the deliverables outlined in the service agreement have been provided to and formally accepted by the Client in writing or as otherwise specified in the service agreement.

Formal Request:
All refund requests must be submitted in writing via email to business@promotionify.com, clearly stating the reason for the refund request, the relevant invoice number, and any supporting documentation. Verbal requests will not be accepted.

4. Conditions for a Refund
A refund may be granted under the following limited circumstances:

Material Breach of Contract: If the Company materially breaches the service agreement by failing to provide the agreed-upon services or deliverables, and such failure is not due to any action or inaction on the part of the Client.

Failure to Meet Agreed-Upon Performance Metrics (with clear evidence): In cases where specific, measurable performance metrics were explicitly defined in the service agreement, and the Company demonstrably failed to achieve those metrics despite reasonable efforts, a refund may be considered. Mere dissatisfaction with results or subjective opinions will not constitute grounds for a refund. The burden of proof for demonstrating failure to meet agreed-upon metrics rests with the Client.

No Refund for Consequential Damages: Under no circumstances shall the Company be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to lost profits, lost revenue, or business interruption, arising from the services provided, unless the Company has been made aware of the possibility of such damages
7. Governing Law
This Policy shall be governed by and construed in accordance with the laws of state of Jharkhand, India, without regard to its principles of conflicts of law.
10. Severability
If any provision of this Policy is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Upon receipt of a valid refund request, the Company will conduct a thorough review to verify the validity of the claim.
Refund Method:
Approved refunds will be processed using the original payment method used for the purchase, unless otherwise mutually agreed upon in writing.
Processing Time:
Please allow up to 7 business days for the refund to be processed and reflected in your account.
6. Dispute Resolution
Any disputes arising under or in connection with this Policy shall be resolved through good-faith negotiation between the parties. If a resolution cannot be reached through negotiation, the parties agree to use a mutually agreed-upon method to resolve the dispute.
8. Entire Agreement
This Policy constitutes the entire agreement between the Client and the Company regarding refunds and supersedes all prior or contemporaneous communications, Any amendments or modifications to this Agreement during the time of onboarding of the client must be in writing and signed by both parties.
9. Amendments
The Company reserves the right to amend this Policy at any time without prior notice. The most current version of the Policy will be posted on our website.
